1. Service Description

FemHealth is a comprehensive women's health platform that provides:

  • Menstrual cycle and fertility tracking
  • Pregnancy milestone monitoring and guidance
  • Postpartum recovery tracking and support
  • Toddler development monitoring (0-2 years)
  • Healthcare professional consultations
  • Educational content and health insights
  • Personalized recommendations and predictions

2. User Responsibilities

By using FemHealth, you agree to:

  • Provide accurate and complete health information
  • Maintain the security of your account credentials
  • Use the service for personal, non-commercial purposes only
  • Comply with all applicable laws and regulations
  • Not share your account with others
  • Report any security concerns immediately
  • Update your information as needed for accuracy

3. Subscription Plans and Pricing

FemHealth offers both Free and Premium subscription tiers:

3.1 Free Tier

  • Basic health tracking (cycle, pregnancy, postpartum, toddler)
  • 3 AI health chats per day
  • Basic analytics and insights
  • Limited health report generation

3.2 Premium Subscription Plans

Premium subscriptions are available with different pricing for Africa and Global regions. Pricing may vary by region and is displayed in the app at the time of purchase. For current pricing information, please check the app or contact [email protected].

Note: Specific pricing details are subject to change and are displayed within the app. The app store listings and in-app purchase screens will show the most current pricing for your region.

3.3 Premium Features

  • Unlimited AI health chat
  • Advanced health predictions and analytics
  • Comprehensive health tracking with all features
  • Unlimited health report generation (PDF exports)
  • Advanced health insights and trend analysis
  • Data export capabilities
  • Priority customer support
  • Early access to new features

3.4 Billing and Payment

  • Payment Processors: Paystack (Africa region) and Stripe (Global region)
  • Payment Methods: Credit/debit cards, bank transfers, mobile money (Paystack), and other methods supported by the payment processor
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled
  • Cancellation: Cancel anytime through your account settings or app store settings. Cancellation takes effect at the end of the current billing period
  • Refunds: Refund policies are subject to app store terms (Apple App Store, Google Play Store) and payment processor policies. Contact support for refund requests
  • Price Changes: We will provide at least 30 days notice for any price increases. Your current subscription will continue at the existing price until renewal
  • Billing Disputes: Contact [email protected] for billing inquiries or disputes

4. AI Health Chat Service

FemHealth provides an AI-powered health chat feature with two options:

  • On-Device AI (Optional): You can choose to use an on-device AI model (Gemma 3 1B) that runs entirely on your device. The model is not included in the app download - it is downloaded separately only if you choose this option. This saves app storage space for users who prefer remote AI. When using on-device AI, your health data never leaves your device for AI processing.
  • Remote AI (Optional): You can choose to use remote AI services for enhanced capabilities. When using remote AI, all personal information is stripped and anonymized before any data leaves your device. We remove all PII including names, exact dates, locations, and other identifying details. Personalization is removed to protect your privacy.
  • Usage Limits: Free users receive 3 AI chats per day; Premium users have unlimited access
  • Medical Disclaimers: All AI responses include medical disclaimers stating that the information is informational only and not a substitute for professional medical advice, diagnosis, or treatment.
  • Chat History: Conversation history is stored locally and encrypted on our servers for continuity across devices
  • Service Availability: AI chat may be unavailable during maintenance or technical issues
  • User Choice: You can switch between on-device and remote AI at any time through app settings.

5. Data Ownership and Privacy

Your data is protected under our Privacy Policy. Key points:

  • Data Ownership: You retain full ownership of your health data. You can export, download, or delete your data at any time
  • Security: All health data is encrypted using AES-256 encryption. Local storage uses platform-specific secure storage (Android Keystore, iOS Keychain)
  • Data Sharing: We never sell your health data to third parties. Data is only shared with service providers necessary to deliver our services, under strict confidentiality agreements
  • Data Export: Premium users can export their health data in PDF or JSON formats through the app
  • Data Deletion: You can request complete data deletion at any time. Account deletion removes all associated data within 30 days

6. Medical Disclaimer and Health Information

Important Medical Disclaimer: FemHealth provides informational content, health tracking tools, and AI-powered insights. The service is not a substitute for professional medical advice, diagnosis, or treatment.

  • Always seek the advice of qualified healthcare providers for medical concerns
  • Do not ignore or delay seeking professional medical advice because of information provided by FemHealth
  • In case of medical emergency, contact emergency services immediately
  • AI-generated health insights are informational only and should not replace professional medical judgment
  • Health predictions and analytics are estimates based on data patterns and should not be considered medical diagnoses
  • Consult with healthcare professionals before making decisions about your health, especially during pregnancy, postpartum recovery, or when dealing with health issues

Not for Emergency Use: FemHealth is not designed for emergency situations. If you experience a medical emergency, call your local emergency number immediately.

7. Service Availability and Limitations

We strive for high availability but cannot guarantee:

  • Uninterrupted service availability (service may be unavailable during maintenance)
  • Immediate response to all requests or support inquiries
  • Compatibility with all devices, operating systems, or browsers
  • Data backup in all circumstances (though we maintain regular backups)
  • AI chat availability at all times (may be unavailable during updates or technical issues)
  • Offline functionality for all features (some features require internet connectivity)

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice to users.

8. User Content and Conduct

When using FemHealth, you agree to:

  • Provide accurate and truthful health information
  • Not use the service for any illegal or unauthorized purpose
  • Not attempt to gain unauthorized access to the service or other users' accounts
  • Not interfere with or disrupt the service or servers
  • Not use automated systems to access the service without permission
  • Respect the intellectual property rights of FemHealth and third parties
  • Not share your account credentials with others

9. Intellectual Property

The FemHealth service, including its design, features, and content, is owned by FemHealth and protected by intellectual property laws. You retain ownership of your health data, but grant us a license to use it to provide our services.

You may not copy, modify, distribute, or create derivative works of the FemHealth service without our express written permission.

10. Termination

Termination by You

You may cancel your account at any time through your account settings or by contacting support. Upon cancellation, your subscription will remain active until the end of the current billing period, and your data will be deleted according to our Privacy Policy.

Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

  • Violations of these Terms of Service
  • Fraudulent activity or payment disputes
  • Extended periods of account inactivity (2+ years)
  • Legal or regulatory requirements
  • Security threats or abuse of the service

11. Limitation of Liability

To the maximum extent permitted by law:

  • FemHealth is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
  • We are not responsible for any health outcomes or decisions made based on information provided by the service

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms in the app and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you should stop using the service and cancel your account.

13. Governing Law and Disputes

These Terms of Service are governed by applicable laws. Any disputes will be resolved through:

  • First, through good faith negotiation
  • If negotiation fails, through binding arbitration or mediation as applicable
  • Subject to applicable consumer protection laws in your jurisdiction
